Terms of Service

These terms are the agreement between you and NOTCH. By creating an account or using the app, you accept them. If you do not, please do not use NOTCH.

1. Who can use NOTCH

You must be at least 13 years old. If you are under 18, you need permission from a parent or guardian. You are responsible for everything that happens under your account, so keep your login details to yourself.

2. Your licence to use NOTCH

We grant you a limited, non-exclusive, non-transferable, revocable licence to use NOTCH on any Apple-branded device that you own or control, or any Android device you own or control, as permitted by the Usage Rules of the App Store or Google Play. This licence is for your personal, non-commercial use.

You may not: copy, modify or create derivative works of the app; reverse-engineer, decompile or disassemble it except where that restriction is prohibited by law; rent, lease, lend, sell, redistribute or sublicense it; or remove any proprietary notices. All rights not expressly granted to you are reserved by us.

NOTCH, its name, logo, design and software are our intellectual property. Nothing in these terms transfers ownership of any of it to you.

3. What NOTCH does, and what it does not

NOTCH suggests places and builds day itineraries using a mix of third-party place data, AI generation, and ratings from other users.

Suggestions are suggestions. Opening hours, prices, availability and even whether a business still exists can be wrong or out of date. AI-generated itineraries can contain mistakes. Check anything that matters — a booking, a long journey, a closing time — before you rely on it. You are responsible for your own safety and your own decisions about where to go.

4. Your content

You keep ownership of everything you post: your ratings, photos, captions and comments.

By posting content publicly in NOTCH, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display and distribute it within the app, for the purpose of operating the service. This licence ends when you delete the content or your account, except for copies already shared with other users and anonymised aggregate ratings that no longer identify you.

You confirm you have the right to post what you post, and that it does not infringe anyone else's rights.

5. Rules

Do not use NOTCH to:

Harass, threaten, bully or impersonate anyone.
Post hate speech, or content that attacks people based on who they are.
Post sexual content, graphic violence, or anything involving minors inappropriately.
Post spam, scams, or misleading commercial content.
Post anything illegal, or encourage illegal or dangerous activity.
Post someone else's private information without their permission.
Manipulate ratings, create fake accounts, or game the ranking system.
Scrape, reverse-engineer, or attack the service or its infrastructure.
Resell or redistribute place data obtained through NOTCH.

6. Moderation

You can report any post, comment or profile from within the app, and block any user. We review reports and aim to act within 24 hours. Content flagged by multiple users may be hidden automatically while we look at it.

We may remove content or suspend accounts that break these rules. For serious or repeated breaches we may do so immediately and without warning. If you think we got it wrong, email us and we will look again.

7. Subscriptions and payment

NOTCH offers a free tier with usage limits, and a paid subscription (NOTCH Pro) with expanded access.

Payment is taken by Apple or Google, under their terms. We never see your card details.
Subscriptions renew automatically until cancelled.
Cancel through your Apple or Google account settings, not through us — deleting the app does not cancel a subscription.
Refunds are handled by Apple or Google under their policies. We cannot issue them directly.
We may change pricing, but not for a period you have already paid for, and we will give notice before a change takes effect.
Promotional codes and free periods may be limited or withdrawn, and cannot be exchanged for cash.

Fair use: Pro is intended for personal use. We may apply reasonable limits to prevent automated or abusive consumption of AI generation.

8. Third-party services and content

NOTCH shows data from third parties including Google Maps Platform. That data belongs to them and is subject to their terms. We do not control it and cannot guarantee it is accurate. Links or references to venues are not endorsements, and we have no relationship with the businesses that appear in the app.

9. Availability

We try to keep NOTCH running, but we do not promise uninterrupted service. We may change, suspend or discontinue features at any time. If we shut the service down permanently, we will give reasonable notice and an opportunity to export your data.

10. Ending your account

You can delete your account at any time in Settings. Deletion is immediate and permanent.

We may suspend or terminate your account if you break these terms, or if we are required to by law. Where reasonable, we will tell you why.

11. Disclaimers

NOTCH is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that recommendations will suit you, that information will be correct, or that the service will be error-free.

12. Limitation of liability

To the fullest extent permitted by law, NOTCH is not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from your use of the service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or twenty US dollars.

Nothing here excludes liability that cannot legally be excluded, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

13. Indemnity

You agree to indemnify NOTCH against claims arising from content you post or from your breach of these terms.

14. Changes to these terms

We may update these terms. If a change is material, we will notify you in the app before it takes effect. Continuing to use NOTCH after that means you accept the new terms.

15. Governing law

These terms are governed by the laws of the State of New Jersey, United States, and the courts there have exclusive jurisdiction, except where the law of your country of residence gives you the right to bring proceedings locally.

16. Legal and export compliance

You represent and warrant that: you are not located in a country subject to a US Government embargo, or designated by the US Government as a "terrorist supporting" country; you are not listed on any US Government list of prohibited or restricted parties; and your use of NOTCH complies with all applicable local, national and international laws.

17. If you downloaded NOTCH from the App Store

These clauses are required by Apple and apply in addition to everything above.

This agreement is with us, not Apple. Apple is not a party to it, and is not responsible for NOTCH or its content.
Scope of licence. The licence in section 2 is non-transferable and limited to use on Apple-branded devices you own or control, subject to the App Store Usage Rules.
Maintenance and support. We are solely responsible for providing any support for NOTCH. Apple has no obligation whatsoever to furnish maintenance or support.
Warranty. If NOTCH fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation at all, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.
Product claims. We, not Apple, are responsible for addressing any claims relating to NOTCH, including product liability claims, any claim that NOTCH fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
Intellectual property claims. If a third party claims that NOTCH infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms and, on your acceptance, will have the right to enforce them against you.
